What is a Lot Improvement?

All improvement matters beyond the truly minor (eg. not related to common services, not potentially affecting common or other property in the body corporate or amenity thereof, not requiring other than personal equipment crossing common property) must be put to Body Corporate using the standard Lot Improvement Application webform. If in doubt, contact the Body Corporate or lodge an application. The Body Corporate is here to regulate and facilitate

Building Use & Classification

Is there any short term/holiday letting in the building?

Bayview Gardens is a residential only building.

There are no short-term letting/rentals in the building and no MCU applications/approvals in place. 

Can a unit be used for short term letting such as Airbnb?

There is no short-term letting/rentals in the building. Note that use of a premises for short-term letting of is regulated by Gold Coast City Council and requires an MCU. Any such application must be informed to the Body Corporate in advance. 

I plan to let/rent my unit out, what do I need to do?

Bayview Gardens is a residential only building.

There is no short-term letting/rentals in the building. 

When you rent out your unit, you need to notify the Body Corporate via the Body Corporate Manager/Strata to inform that (1) unit is now rented (2) provide agent contact details.

I plan to let/rent my unit out, can my agent put up a sign?

Air Conditioners

I would like to install an air conditioner, what do I need to do?

Air conditioners will require a condenser unit to be mounted outside the unit. There are several considerations that are important for the building and all owners, including location of the condenser unit, penetrations through wall to connect the condenser, waste-water, waterproofing, as well as safe access arrangements. 

Installation requires an approval from the Body Corporate.

Approvals from the Body Corporate include information and conditions to aid installations and make you (and installers!) are aware of factors that are important so to avoid problems.

My air conditioner needs replacement, do I need to get approval?

When replacing an Air Conditioner approval from the Body Corporate is required as installations of condenser units and their connections are on Common Property. There are several considerations that are important for the building and all owners, including location of the condenser unit, penetrations through wall to connect the condenser, waste-water, waterproofing, as well as safe access arrangements. These matters are important for integrity of the building at any moment.


Approvals from the Body Corporate include information and conditions to aid installations and make you (and installers!) are aware of factors that are important so to avoid problems.

My air conditioner is leaking water, what can I do?

If you have noticed or been advised that your air conditioner is leaking water on to ledges and on to other units, you will need to contact an installer/repairer to mitigate that issue.


Should access to the outside of the building or addressing of plumbing connections be needed, then you need to contact the Body Corporate to seek approvals and assistance,

Bathroom Renovations

I am planning to renovate my bathroom, what should I do?

It is essential that bathrooms are maintained as waterproofed. Water proofing under screed shall extend continuously into floor drainpipes before termination and shall extend seamlessly at wall returns per Building Code of Australia (BCA).
Wall tiling needs to be continuous to the floor (in front of waterproofing. Wall tiles may not be laid over existing tiles. 

All renovations require Body Corporate approval.


Front Door of Unit

Can I add a door latch stop that keeps my front door open?

No

Fire Doors may not be kept open - your unit door is a Fire Door.

Latches/clips of any type that keep Fire Doors open are not permitted and will be removed following regular regulatory inspections.

Cost for removing such latches/clips will be invoiced to the unit owner

I want to change the lock/key for my front door, can I?

The lock-barrel ("key") is the only item that you may change without permission, although it is recommended that you should discuss with the Executive Committee prior to undertaking.


Note that most unit doors in the building are keyed from a master.

Certainly, changing a door lock-barrel/key should be informed to the Body Corporate so that it is clear for emergency action whether there is access available.

Lots not on the master key system are encouraged to provide a key to be secured in the Body Corporate Key Safe for emergency or regulatory access.

Note the Body Corporate (there not being an onsite caretaker/manager) does not provide “lockout” services at all.

Changing/Replacing the door set (handle and latch) is not permitted without approval from the Body Corporate.

Owners should note that unapproved penetrations (“holes”) in Fire Doors are not permitted. Where changing a door/lever set is undertaken:

  1. that Door Set type must be approved for Fire Doors [evidence must be supplied to the Body Corporate in advance] and
  2. the penetration requirement of the Door Set must match the existing penetration (hole) in the Fire Door [evidence must be supplied to the Body Corporate in advance].
In the event of an unapproved penetration in a Fire Door, the lot owner is responsible for the replacement of the door and door set – cost is in the order of $1500+GST, plus certification and inspection fees.

In the event of an unapproved door level/handle/lock set being installed in a Fire Door, the lot owner is responsible for the replacement of the door and door set – cost is in the order of $1500+GST, plus certification and inspection fees.

The door set/lock on my Front Door is broken, will the Body Corporate replace that?

In general, the doorset/latch/handle/lock must be maintained by owner of the unit. Costs for maintaining thedoorset/latch/handle/lock are the responsibility of the owner.


If indeed the Body Corporate determines the doorset/latch/handle/lock has failed or is EOL (end-of-life) the Body Corporate will replace. Such determinations may be as a consequence of regulatory inspections undertaken by the Body Corporate from time-to-time.

Can I paint my Front Door?

Your front door is a Fire Door and highly regulated.


You can paint the inside of your front door.

You may not paint the outside of the front door nor the edges/sides of the front door.

Can change/replace door number sign on the Front Door?

No


The outside front door of your unit is regulated by the Body Corporate. Signage for unit numbers is provided by the Body Corporate and may not be changed or altered.

Can I install a viewer/peephole in my Front Door?

In general, no penetrations of Fire Door are permitted.


Should you wish to install such a device then you must apply to the Body Corporate for approval and supply evidence to the Body Corporate that the Peep/View Hole device is approved for use on a Fire Door.

Owners should note that unapproved penetrations (“holes”) in Fire Doors are not permitted.

In the event of an unapproved penetration in a Fire Door, the lot owner is responsible for the replacement of the door and door set – cost is in the order of $1500+GST, plus certification and inspection fees.

In the event of an unapproved door level/handle/lock set being installed in a Fire Door, the lot owner is responsible for the replacement of the door and door set – cost is in the order of $1500+GST, plus certification and inspection fees.

The frame of my Front Door is rusted, will the Body Corporate remediate that?

Owners should endeavor to take care of the door frame, regularly wiping down (dry) the frame to remove dust/grit build up to prevent rust.


Rusted door frames are potential defects that the Body Corporate may need to remedy, and as such are a potential cost for all owners via levies.

Door frames may only be Painted by the Body Corporate (door frames may not be painted by owners).

Can I install a seal, sweep or guard on the bottom of my Front Door?

No.


No attachments may be made to a Fire Door.

In the event of an unapproved device on a Fire Door, the Lot Owner is responsible costs of removing such as well as fixing (holes in) the door plus certification and inspection fees.

Can I fit a seal around the frame of my Front Door?

No.


No attachments may be made to a Fire Door Frame

In the event of an unapproved device on a Fire Door Frame, the Lot Owner is responsible costs of removing such as well as repairs costs plus certification and inspection fees.

Flooring Covering Replacement/Change

I want to replace my flooring, what do I need to do?

Changing flooring is potentially one of the most contentious issues in a renovation. All flooring changes or replacements require Body Corporate approval.


The high ceilings in the units means there is no ceiling space and no void to dampen footsteps and noise.

You must ensure that regulations and standards including Building Code of Australia (BCA). applying multi-storey dwellings and the acoustic underlay requirements are met/exceeded. Applicable standard is AS1276-1 "with L’nT,w + C" of less than 48.

In general tiles-on-tiles are not acceptable. 


I want to put down flooring tiles, what do I need to do?

Fly Screens


Can I install fly screens?

You can install fly screens on balcony doors without approval, providing those are "clear" and are not in contravention of the Window Coverings Bylaw.


To install fly screens on the exterior-inaccessible sliding windows a Body Corporate approval is required if those are to be fitted to the exterior.

 (Installation/replacement of fly screens internal to windows is at owner discretion, subject to window coverings bylaw).

My fly screens need repair/replacement

Many units have had Fly Screens fitted in (many) years gone by. Owners should take care to ensure that fixing of flyscreens is safe and secure (maintain & care for the installation). The Body Corporate notes that a number of the legacy installations using plastic retainers/clips are suspectable to degradation and that those installations may be/become insecure.

Owners are responsible for the integrity of the Fly Screens installed on their windows and the Body Corporate is in no way responsible (and should be regarded as indemnified) in the event of such fly screens causing damage or injury in the events where those are no longer retained howsoever caused.  

My windows did not get cleaned

Exterior-inaccessible windows with Fly Screens fitted are unable to be washed by contractors for the Body Corporate.

Body Corporate contractors are unable to remove/replace fly-screens.

Kitchen Renovations

I am planning a kitchen renovation, do I need an approval?

I am replacing the rangehood, do I need an approval?

Replacement of a rangehood (appliance) does not require Body Corporate approval.

Note that only duct-less rangehoods may be installed. Connection of ducted rangehoods to extraction is not available.

Background: The building was certified in 1990 at which time the BCA did not require rangehood air extraction (introduced in 2019) and the buildings' mechanical ventilation system was not designed for such.
